They overcharged them. The driver is liable for manslaughter. The arresting officers for misconduct and false imprisonment. This isn't a fed case. Fed cases are better because teh resources and the jury pool is conducive to conviction. If this gets moved to a rural county they all walk. If they move it and it goes to PG county these cops are in trouble.
